OGEL/TDM Special: Call for Yukos Papers
6 August 2014
Update August 2015: The joint TDM / OGEL Yukos special has been published, you find the table of contents here: TDM 5 (2015) - Yukos special and OGEL 5 (2015) Yukos special (you can download a free excerpt via these links as well).
We are seeking proposals for articles on various aspects of the Yukos Energy Charter Treaty award and the Yukos ECHR judgment for a joint OGEL and TDM special.
Candidly, OGEL/TDM is not seeking a "case note"; there will be many of those in the near future written by many people and published in many journals. Rather, we are seeking thoughtful pieces to discuss aspects of the decisions that benefit from a fuller exploration - among the possible topics that come to mind are whether the liability findings broke new ground or were fundamentally an application of accepted international legal principles, comparative fault in international law, the related issue of whether international investment law can properly play a role in combating official corruption and cronyism, the computation of damages in oil & gas disputes, how one goes about enforcing an award of such a size (US$ 50 billion +, or even the comparatively de minimus 1.8 billion from the ECHR and whether enforcement is practically feasible/infeasible regardless of whether the valuation is correct, overlaps between politics and prosecution of cases-before/enforcement-of- awards-from tribunals established to de-politicize disputes, and etc.
