d) Op 19 januari 2024 heeft de District Court of the Eleventh Judicial Circuit in and for Miami-Dade County, Florida, een 'Order confirming arbitration award and Final Judgement on the award' uitgevaardigd. Deze Order and Final Judgement luidt onder meer als volgt:
"1. The Court is satisfied with the sufficiency of the arbitrator's determination and award. The decision and award made by the arbitrator is in all respects confirmed, in accordance with § 682.12 of the Florida Statutes. Nestor v. Ward, 163 So. 3d 582, 585 (Fla. 3d DCA 2015) ("In the absence of a motion to vacate, modify, or correct the arbitration award, the trial court must confirm the award.").
2. Accordingly, a final judgment is hereby entered in favor of the plaintiff, 111Repair, LLC, and against Alianza Glancelot, C.A., in the amount of $92,931.51, which sum shall bear interest at the rate of 9.09% per annum, as prescribed by § 55.03 of the Florida Statutes, from the date of entry of this Final Judgment.
3. Pursuant to the Award, the Plaintiff prevailed on all of its claims against Alianza and Albatros, jointly and severally, with the Award rendered in favor of the Plaintiff for the amount of $400,000.00 in damages as to Counts VI and VII, and $1,520.00 for costs of the arbitration, for the total of $401,520.00. See the Award, Ex. 1, at 7.
4. A final judgment is hereby entered in favor of the plaintiff, 111Repair, LLC, and against the defendants, Alianza Glancelot, C.A., and Albatros Aviation International Corp., jointly and severally, in the amount of $401,520.00, which sum shall bear interest at the rate of 9.09% per annum, as prescribed by § 55.03 of the Florida Statutes, from the date of entry of this Final Judgment.
