Inside Counsel Should be Active in Mediation
Published 24 October 2014
Abstract
Although the contributions of neutrals and outside counsel in the mediation process are generally understood in the business dispute resolution community, the potential for key contributions by inside counsel sometimes are overlooked. Inside counsel’s role-specific strengths include understanding of business goals, personal association and trust with executives, and industry and technical understanding. Inside counsel are free to communicate with their opposite counterparts, an effective avenue to build understanding toward a negotiated solution. This article describes methods and attitudes house lawyers can use to increase the chance of acceptable mediated dispute resolution.
